The U.S. Institute of Peace experienced a legal setback last week when the DC Circuit Court of Appeals upheld a stay order on Judge Beryl Howell's earlier decision in the Institute's favor. This means that USIP remains under DOGE control until a full appeal decision, expected in November or later, and is effectively unable to operate. However, Judge Howell's ruling that the administration's actions are "null, void, and without legal effect" remains intact and has not been reversed. Recent reports of a new USIP acting president should be seen in this light. The "appointment" is invalid, as it was made by only two ex officio board members. Today, George Foote, USIP counsel, said: "The announced appointment of Darren Beattie as the President of the U.S. Institute of Peace flies in the face of the values at the core of USIP’s work and America’s commitment to working respectfully with international partners. It is also illegal under Judge Howell's May 19 decision. We are committed to defending that decision against the government’s appeal. We are confident that we will succeed on the merits of our case, and we look forward to USIP resuming its essential work in Washington, D.C. and in conflict zones around the world. “For more than 40 years, USIP has served as a trusted source of independent research and analysis and as an intermediary responsible for convening diverse stakeholders around the world to achieve peace.
