[54] The RPD found that the US is a "highly democratic" country with a judiciary that is "largely independent". The country has strong safeguards against official corruption and due process in civil and criminal matters is widely observed. Although there have been some challenges to democratic institutions in recent years, such as through partisan manipulation of the judicial appointment process, alongside chronic weaknesses, including racial bias in the criminal justice system, the US maintains one of the highest levels of judicial and state protection available in the world. Despite some efforts by the Trump administration to undermine democratic processes, the courts continued to "regularly demonstrate their autonomy by blocking or limiting executive and legislative actions". [55] Accordingly, and in line with the jurisprudencec, the RPD determined that Ms. B has a "heavy burden" of proof when it comes to rebutting the presumption that the US cannot protect her. [56] Ms. B argues that RPD erred by relying on the "strong rule-of-law traditions" in the US and its "functioning independent judiciary". She submits that the RPD ignored the fact that the judiciary does not render actual protection and uses these traditions to persecute trans people.

INCLUSION OF EL SALVADORIAN NDP DOCUMENTS [] The Applicant also seeks to admit the following documents from the National Documentation Package for El Salvador to the Applicant’s record: 6.1, 6.2, 6.3, 6.4, 6.5, 6.7, 6.8, 7.7, 7.22, 7.24, 7.26, 9.4, 9.6, and 9.7. [] The reason to admit these is due to recent developments including the Trump administration’s decision to start deporting people to the El Salvadorian concentration camp called “Centro de Confinamiento del Terrorismo” or “CECOT”. [] This is relevant to the Applicant as President Trump has been overheard talking to El Salvadorian President Nayib Bukele about deporting US citizens to El Salvador for the purposes of imprisoning them at CECOT. [] The Applicant feels that she and other similarly-situated individuals are at risk of being deported to CECOT due to the Trump Administration’s executive orders demonizing transgender people, equating advocating for the fundamental human rights of transgender children as “child abuse” and labelling transgender people as a group are morally inferior due to being transgender (see para. 33 in this Application as it relates to the Military Readiness EO). As a result, the Applicant feels that transgender people as a group are at a high risk to be targeted for deportation by the Trump administration, regardless of whether the trans people have citizenship. [] This is also more likely when you consider how Trump is attacking trans people’s right to access accurate identity documents and proof of citizenship (such as a passport).

In that case, an American Indian chief who was convicted of federal criminal charges fled to Canada before sentencing. Arrested in Canada a year later, he claimed refugee status. The persecution he alleged to have feared was a risk to his life if incarcerated in a federal prison. The Federal Court of Appeal found that Satiacum's fear did not meet the objective component of the test for fear of persecution, as it must be presumed that the United States judicial system is effective in affording a citizen just treatment. The court stated, at p. 176: In the absence of exceptional circumstances established by the claimant, it seems to me that in a Convention refugee hearing, as in an extradition hearing, Canadian tribunals have to assume a fair and independent judicial process in the foreign country. In the case of a nondemocratic State, contrary evidence might be readily forthcoming, but in relation to a democracy like the United States contrary evidence might have to go to the extent of substantially impeaching, for example, the jury selection process in the relevant part of the country, or the independence or fair-mindedness of the judiciary itself.

[] Further, there is a brewing constitutional crisis in the United States that the Applicant cannot yet comment on given how recent the events are unfolding. At this time, the executive office is ignoring a temporary restraining order issued by a federal judge, which is starting to show an unravelling of the state apparatus, as described in Ward. The Applicant would request two months after the filing of this Further Memorandum of Argument to monitor the situation and amend this argument with more details.
[] The Supreme Court of Canada, in Ward, essentially adopted paras. 98-100 of the UNHCR Handbook as being an “entirely reasonable reading of the current definition” and in para. 99, it holds that “refusal of a national passport or extension of its validity [
] may constitute a refusal of protection within the definition”. Ward, supra, at 718.
[] President Trump has implemented an Executive Order which is inappropriately titled “DEFENDING WOMEN FROM GENDER IDEOLOGY EXTREMISM AND RESTORING BIOLOGICAL TRUTH TO THE FEDERAL GOVERNMENT” (hereinafter referred to as “’GENDER IDEOLOGY’ EO”) in spite of the fact that it literally does the opposite. It uses a definition of “female” and “male” that is scientifically inaccurate, debunked in peer-reviewed journals. Further, it seeks to cause significant interference with the daily lives of transgender people, a position which is objectively “extremist” and is objectively not “defending” anyone – least of all women. Executive Office of the President, “Defending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government”, 90 FR 8615 [] It holds that female people are “belonging, at conception, to the sex that produces the large reproductive cell” and that male people are “belonging, at conception, to the sex that produces the small reproductive cell”. However, this definition as it pertains to identity documents is unhelpful and not fit for purpose. Further, it is used to specifically deny transgender people fundamental human rights. Ibid., sec. 2(d-e)
[5] Additionally, new developments in the United States invoke concerns regarding non-refoulement and the ability of the Applicant to be returned to the United States. These include executive orders which directly attack the fundamental human rights and dignity of transgender people and a refusal by the executive branch of the American government to adhere to the checks and balances. This could constitute both an admission of an inability or unwillingness to protect and a complete breakdown of the state apparatus, both described by Ward. Canada (Attorney General) v. Ward, 1993 CanLII 105 (SCC). [6] It is for all these reasons that leave should be granted.
Applicant's Further Memorandum of Argument Overview [] Counsel for the Respondent seeks to misrepresent several of the Applicant’s arguments while ignoring the glaring deficiencies and erroneous findings of fact and law by Justice Pallotta. [] Counsel for the Respondent also failed to mention or address the factual inaccuracies that the Federal Court made, which open the Applicant up to inadmissibility findings due to misrepresentation under section 40 of the Immigration and Refugee Protection Act – not because the Applicant had actually made any sort of misrepresentation of fact but because of the Court’s error. [] Also, the Respondent, in his response, fails to take into account the Applicant’s status as a self-represented litigant. The Applicant made an effort to appeal the Pallotta decision to the Federal Court of Appeal and was denied. The Applicant’s ignorance of how to exercise her right to appeal or judicial review is due to her being a self-represented litigant. The Respondent seeks to unfairly penalize the Applicant due to her being a self-represented litigant. Pintea v. Johns, 2017 SCC 23 Girao v. Cunningham, 2020 ONCA 260 [] Furthermore, the declaration that the RAD’s decision is “reasonable” is manifestly absurd and is an attack by the Respondent upon the dignity of this Court.

[] But more horrifically, it states that transgender US citizens can no longer get accurate identity documents and severely limits the ability of transgender persons to get accurate proof of citizenship. US passports, and other such federally issued documents, are critical proofs of identity and citizenship. Passports are considered “column A” documents by US Citizenship and Immigration Services because they are considered to prove both right to work in the United States and identity. All of the documents listed on the I-9 form, along with the ability to obtain said documents, are adversely impacted by this decision. Form I-9: Employment Eligibility Verification, Department of Homeland Security [] As a result of the “GENDER IDEOLOGY” EO, the ability of transgender people to seek legal employment is severely impacted. This unreasonable barrier to employment to transgender individuals constitutes persecution per Ballestro Romero. Ballestro Romero v. Canada (Citizenship and Immigration), 2012 FC 709, para. 7
