One is to blame government failure, rather than market failure, for observed environmental problems. A second is to deny that the apparent victims of pollution are actually the owners of the property rights they claim to be violated. A third approach is to erect procedural barriers that make it impossible, in practice, for pollution victims to obtain redress for the harms they suffer. A fourth is to fall back on consequentialism. And a fifth is to argue the validity of the science behind the claim that harm has occurred. Here are some examples of each of the modes of escape.
