This is, IMO as a lawyer, a very important point. The most similar case I’m aware of was in Eliz City, NC, where deputies surrounded a car on foot knowing the victim intended to flee. The very GOP DA refused to indict but the City paid handsomely because it knew the jury wd see an attempt to flee
