Courts may not “rewrite the statutory scheme in order to approximate what we think Congress might have wanted had it known that” the President or courts may conclude that its removal restrictions were “beyond its authority.” Seminole Tribe of Fla. v. Florida, 517 U. S. 44, 76 (1996).
Surrogacy cases are confidential under Florida law. But when Weiss published his order, he wrote that his ruling was not confidential because it didn’t share identifying information about the child or parents. A month later, he submitted it as part of his application to be on Florida’s Fourth District Court of Appeal. And in December, the order was published in a law trade journal. But, as this production makes clear, Miller’s Willy is a more carefully drawn character than that. He’s not simply an avatar for all us little guys. He isn’t Everyman: He’s a specific, recognizable kind of danger. If this is Willy as a “common man,” just imagine him with power. Sitting at the Winter Garden, I did — and I recognized him. It is profoundly misguided to cast health care based on low-certainty evidence as bad care or as care driven by ideology, and low-certainty evidence as bad science. Many of the interventions we offer are based on low certainty evidence, and enlightened individuals often legitimately and wisely choose such interventions. Thus, forbidding delivery of gender-affirming care and limiting medical management options on the basis of low certainty evidence is a clear violation of the principles of evidence-based shared decision-making and is unconscionable. The appropriate use of our work is in ensuring patients receive needed care and in helping TGD patients and their clinicians in decision making.
