Excerpt from Fifth Circuit's 2024 decision in U.S. v. Connelly (case 23-50312), which is the first linked document in this post. Relevant portion underlined: “our history and tradition may support some limits on a presently intoxicated person’s right to carry a weapon … but they do not support disarming a sober person based solely on past substance usage.”

The definition of “Unlawful user of or addicted to any controlled substance” from 27 CFR 478.11, which is the second document linked in this post. The three occurrences of “within the past year” are underlined within this sentence: “An inference of current use may be drawn from evidence of a recent use or possession of a controlled substance or a pattern of use or possession that reasonably covers the present time, e.g., a conviction for use or possession of a controlled substance within the past year; multiple arrests for such offenses within the past 5 years if the most recent arrest occurred within the past year; or persons found through a drug test to use a controlled substance unlawfully, provided that the test was administered within the past year.”
