It’s gross that the administration — in its never-ending effort to harass and intimidate reporters who reveal its incompetence — is going after the communications of journalists’ relatives. The administration’s own guidelines say pursuing journalists is a last resort. But instead, it’s looking for any excuse to snoop on reporters and their relatives, because this has nothing to do with national security and everything to do with chilling journalism. They’re even seeking records from months before the report they claim they’re investigating.

The Court should enforce the plain language of the existing Stipulation and Order and direct immediate disbursement of funds held in the CRIS. Defendant Trump obtained a stay of execution pending appeal only by explicitly agreeing that the funds placed in the Court’s account would be disbursed upon the conditions set out in the Stipulation and Order. Those conditions were satisfied when the Supreme Court denied his petition for certiorari. Nothing in the Stipulation and Order, the Federal Rules, or the Supreme Court’s Rules permits him to disregard the parties’ agreement subsequently so ordered by Your Honor based on the fact that he is considering seeking reconsideration of the denial of certiorari.2 Accordingly, the Court should direct the Clerk to disburse to Carroll the value of the judgment including post-judgment interest, which amounts to $5,779,783.00 in total as of the date of this filing.
As the Court remarked earlier this week, “[a]ll attorneys, as ‘officers of the court,’ owe duties of complete candor and primary loyalty to the court before which they practice.” ECF 50 (Order) at 4 (quoting Malautea v. Suzuki Motor Co., 987 F.2d 1536, 1546–47 (11th Cir. 1993)). That duty of candor is more important than ever now considering what occurred last night, particularly on the heels of the Acting Attorney General’s false statement and other egregious statements by high ranking Administration officials detailed in the SPLC’s prior motions. In light of the apparent breaches of grand jury secrecy and proper DOJ practice, the SPLC respectfully asks the Court to issue an Order requiring DOJ and the USAO to show cause explaining its conduct and why it should not be sanctioned considering the prejudicial consequences at stake here.

This Court acknowledges that the events leading up to this case are, in a variety of ways, unprecedented. But the “Richey test has been in place for nearly fifty years” and “its limits apply no matter who the government is investigating.” Trump, 54 F.4th at 701. To apply the law differently here because of what this case is about, or whose records are at issue, would “defy our Nation’s foundational principle that our law applies to all, without regard to numbers, wealth, or rank.” Id. (citation modified). As explained in this Order, each of the factors, including the first and most important factor—callous disregard—weighs against this Court’s exercise of jurisdiction. As such, Petitioners’ Amended Motion for Return of Property pursuant to Federal Rule of Criminal Procedure 41(g) [Doc. 30] is DENIED. The Clerk is DIRECTED to close this case.
Moreover, the public comments in question—whether the SPLC ever shared information obtained by its field sources with law enforcement—are simply not relevant to the charges in the indictment. This case is about fraudulently obtaining money from donors, lying to banks, and concealing payments to the same organizations the SPLC publicly told donors they were fighting against. (Doc. 1 at 3–6). What, if anything, the SPLC did with the information it obtained through field sources is not relevant to the charges.
On April 26, 2026, Acting Attorney General Blanche made the following statement on Fox News Sunday with Shannon Bream, “It is true that over the years they have selectively shared information with law enforcement. That’s well-documented and there’s no dispute there. They aren’t charged with any of that conduct.” To the extent that any clarification was needed, Acting Attorney General Blanche’s remarks on a major Sunday television program2 certainly suffice.
It is no coincidence that within weeks of the December 22 Order, DOJ opened this “criminal” investigation.9 Notably, Respondent concedes that it opened this investigation not in response to any new allegation of wrongdoing whatsoever, but at the urging of Kurt Olsen, who serves at the pleasure of the [...] And, for reasons that Respondent has declined to articulate, the FBI acted almost immediately after Mr. Olsen snapped his fingers.
Today, Judge Susan Brnovich rightfully dismissed the Trump Administration's lawsuit demanding Arizona hand over its statewide voter registration rolls to the federal government. That database contains the sensitive personal information of millions of Arizona voters — home addresses, dates of birth, and Social Security and driver's license numbers. But the Court was clear: Title III of the Civil Rights Act does not authorize this demand. This is now the sixth federal court to reach the same conclusion. Arizona acted correctly in refusing this request, and today's ruling vindicates that decision. Our offices will continue to defend the privacy of Arizona voters against federal overreach.
