The court reaffirmed what Wong Kim Ark settled over a century ago: Citizenship by birth on U.S. soil is a constitutional right. Today’s decision in Watson allows states to count mail ballots that are postmarked by Election Day but received a certain number of days after. This is a critically important decision: it maintains the status quo, as many states currently allow this under their own election laws, and it confirms the long-held understanding of federal law that permits it. From a practical perspective, the decision is a big win for election officials, who will not be required to overhaul any of their current practices as they continue to prepare for the upcoming midterm elections. The Supreme Court in this case unanimously held that a state court claim against the Chevron oil company could be removed to federal court because the actions challenged by the plaintiff parish were related to Chevron acting as a federal contractor. While seemingly technical, this case has implications for other lawsuits challenging federal contractors. -- Professor Steph Tai, University of Wisconsin Law School
