The Court takes judicial notice that on July 15, 2026, Secretary of War Pete Hegseth announced a new annual screening program for all service members 30 and older, including women, for testosterone deficiency. See Video by Secretary of War (@SecWar), X, The High-T Department of War (July 15, 2026), https://x.com/SecWar/status/2077425458430230838/video/1?s=46. Those with low testosterone will receive, on a voluntary basis, testosterone replacement therapy (TRT), which the Department of Defense describes as part of their "periodic health assessments." Id.The Military Ban states that "the Armed Forces must adhere to high mental and physical health standards...without the benefit of routine medical treatment or special provisions." Exec. Order No. 14183, 90 Fed. Reg. 8757, 8757 (Jan. 27, 2025). The Court must assess the impact of this newly announced policy on the parties' positions. It therefore ORDERS the parties to address, as part of their forthcoming briefing on discovery and summary judgment: (1) medical guidelines associated with routine screening for testosterone deficiency in the general population and in individuals with symptoms and signs of testosterone deficiency; (2) medical guidelines for monitoring the administration of TRT; (3) the similarities and differences in administering TRT, both medically and logistically, for trans men compared to other service members, including cis individuals; (4) the medical costs associated with screening for testosterone deficiency and providing TRT to service members who do not identify as trans; (5) the Department's basis for treating trans men and other service members differently between this new policy and the Military Ban; and (6) any other information or clarification the parties wish to present on this topic. The entry's text: MINUTE ORDER. As stated at the hearing on June 30, 2026, the Court ORDERS that:1. The parties shall file simultaneous briefs not to exceed ten pages per side on the impact on this litigation, if any, of West Virginia v. B.P.J., 609 U.S. --- (2026) (No. 24-38), 2026 WL 1868739. The parties shall propose a schedule for this supplemental briefing. 2. The parties, in collaboration with each other and the Shilling plaintiffs, shall, on or before July 7, 2026, at 5 p.m., propose via joint status report a new class definition that addresses the Court's concerns including (a) deciding whether to include members of the Gender Justice League, the associational plaintiff in Shilling; (b) defining additional sub-classes to alleviate the Government's commonality and typicality concerns; and (c) and altering the class definition with respect to the meaning of "transgender" in a manner consistent with the Hegseth Policy's definition. 3. Should the Government maintain any objections to certification even with the revised definition, the Government shall state those objections succinctly in the joint status report setting forth the new proposed class definition. 4. Also on July 7, 2026, at 5 p.m., the parties shall propose a schedule that controls this litigation, including any briefing that the parties anticipate will take place ahead of trial on January 4, 2027. The parties shall also propose next steps, as necessary, to address the D.C. Circuit's decision on appeal in this case. See Talbott v. United States, 176 F.4th 720 (D.C. Cir. 2026). 5. Class counsel shall notify all class representatives immediately as to the "SCOTUS specialty" firm that they represented has offered to assist with any further appellate matters and within two business days when and if any additional counsel offers assistance. Class representatives must obtain independent, non-conflicted counsel to advise (a) whether they should retain any counsel, and in particular any new appellate counsel, that offers assistance; and (b) on the scope of that counsel's role, if any.
