It’s easier for Americans to imagine the end of everything, cities burning, oceans rising, civilization collapsing into ash, than to imagine the beginning of anything: a general strike that shuts down the economy, rent strikes that threaten property owners, tax resistance that defunds war, mutual aid that isn’t performative, solidarity that costs them their comfort, trust deep enough to actually fight power instead of waiting for it to collapse.

Thankfully, I don’t think I know a single person in this profession who would do those things. So why is it what we’re demanding of our future colleagues? Why is the bar exam this special exception where, time and time again, we’ve been known to endorse frankly flabbergasting cruelty and safety hazards (see eg, in person bar exams during the height of covid) and just looked the other way? What a disgrace. “

LinkedIn post from me that reads: Still thinking about a very cool email I got recently from a prospective client. It said “if I engage, you must receive substantial origination credit. Otherwise, I’m out.” Luckily, that’s a non-issue at my firm. We enthusiastically and meaningfully reward originators - they don’t need a “Partner” title to get credit. But I know that’s pretty rare. There are tons of firms out there where partners will pat an originating associate on the back, and swoop the credit for themselves. So I loved that this prospective client recognized that, and preemptively (and in writing!) put a thumb on the scale of justice for me. If you’re hiring legal counsel, it’s not your responsibility to right a firm’s internal wrongs. But you have power to do so all the same. Don’t be afraid to use it.
