Cops may be able to make that determination without establishing probable cause, a concept defined in case law, the advocates said. “What this means in practice is that anything a police officer does in connection with or in response to a crime — and that could be a misdemeanor — would allow them to actively and affirmatively notify ICE or CBP about the person,” said Yasmine Farhang, executive director of the Immigrant Defense Project. “As long as they can say that they are initiating an investigation of any crime, they can notify ICE and CBP.”

However, “as good citizens, the oil companies complied with the request.” The declassified State Department and CIA documents reviewed in this Appendix establish that President Eisenhower’s request to the oil companies was made pursuant to the United States’ plan to overthrow the “Castro regime” by armed force that culminated in the Bay of Pigs invasion in April 1961. The declassified documents further show that, in addition to having the three refineries refuse to refine the Cuban State’s Soviet oil, the U.S. sought to advance its goal of cutting off Cuba’s oil supply to the fullest extent possible by persuading the governments of other countries to discourage the sale and shipment of oil to Cuba by their oil and shipping industries; having the world tanker industry refuse to carry Soviet oil to Cuba; and sabotage of the oil refineries

Courts’ concerns over noncompliance with judicial orders (over 15 cases) 2. Courts’ distrust of government information and representations (over 35 cases) 3. Courts’ findings of “arbitrary and capricious” administrative action (over 50 cases)

New York City has long been at the vanguard of interfering with enforcing this country’s immigration laws. Its history as a sanctuary city dates back to 1989, and its efforts to thwart federal immigration enforcement have only intensified since. 7. The challenged provisions of New York City law reflect the City’s intentional effort to obstruct the United States’ enforcement of federal immigration law, by (among much else) impeding the consultation and communication between federal and local law enforcement officials that is necessary for the United States to enforce the law and keep Americans safe.

In addition to using longtime U.S. detention facilities at Guantánamo Bay in Cuba, the Trump administration is seeking more far-flung locales to hold deported people, regardless of their countries of origin. The U.S. is already using the notorious Terrorism Confinement Center, or CECOT, in Tecoluca, El Salvador, and has its sights set on numerous other countries, including many that the State Department has excoriated for human rights abuses. The U.S. has reportedly explored, sought, or struck deals with at least 19 countries: Angola, Benin, Costa Rica, El Salvador, Eswatini, Equatorial Guinea, Guatemala, Guyana, Honduras, Kosovo, Libya, Mexico, Moldova, Mongolia, Panama, Rwanda, Saudi Arabia, Ukraine, and Uzbekistan.
