SUMMARY Congress created the Federal Communications Commission (FCC or Commission) to serve the public interest—not to serve as a partisan political weapon. Its extraordinary decision to require early renewal of eight Disney-owned ABC broadcast licenses breaks from decades of practice and causes severe constitutional problems by at least appearing to use the Commission’s licensing authority to censor protected speech. Both the Communications Act and the First Amendment prohibit the FCC from using its regulatory authority to reward favored viewpoints or punish disfavored ones. The timing and rationale of this FCC action strongly suggest it is being used to pressure broadcasters over editorial content rather than address actual legitimate regulatory violations. The Commission should rescind the Early Renewal Order and reaffirm its longstanding commitment to administering broadcast license renewals according to established legal standards. In addition to demonstrating the FCC’s continuing fidelity to the First Amendment, rescinding this order would preserve settled reliance interests and begin to restore public confidence that the FCC remains an independent regulator committed to impartial and consistent enforcement of the Communications Act.

WISPs operate facilities that use devices certified under Section 15.247 in the 5725-5850 MHz Industrial-Scientific-Medical ("ISM") band and other devices certified under Section 15.407 in the 5725-5825 MHz U-NII-3 band. Millions of unlicensed devices, including WISP equipment, Wi-Fi, utility communications and consumer devices, also rely on Commission certification under these two rule sections.”2 We continue to believe that to be an accurate estimate today for U-NII-3 unlicensed devices and devices operating in other unlicensed spectrum bands in rural areas. Two WISPA vendor members that manufacture unlicensed devices estimate that there are at least 572,000 UNII-3 band radios, which those companies sell, that are currently deployed in rural areas. There are at least 12 companies that sell radios and devices to operate in the U-NII-3 bands in the United States. So, that 572,000 figure is only likely to be substantially higher. With respect to the 902-928 MHz band, WISPA said in 2024 in the NextNav rulemaking proceeding that “WISPA members use the Lower 900 MHz band to serve numerous homes and businesses in heavily forested and rural areas where they are surrounded or otherwise blocked by trees. These locations cannot be reached by signals in the 5 GHz or 6 GHz bands, and in only limited cases are signals in the 2.4 GHz or CBRS bands able to penetrate foliage well enough to reach them. In addition, because of the remote location or challenging terrain, many of these areas would not be cost-effective for fiber deployment.”3 With regard to the 2.4 GHz band, in a 2004 Notice of Proposed Rulemaking, the FCC said this about widespread use of that band: “Part 15 unlicensed devices and wireless broadband services using such devices have been extremely successful. The past few years have witnessed the development of broadband unlicensed industry standards such as IEEE 802.11b (Wi-Fi), Bluetooth, and Home RF that have greatly expanded the number and variety of devices that …

Another Smith Here @1MoreSmithHere AST SpaceMobile and the MNO Arbitrage Opportunity I want to discuss two clear arbitrage opportunities facilitated by $ASTS 1) AST raises the value of mid band spectrum in rural and suburban areas as it drops the buildout and operating cost normally associated with mid band spectrum (and underutilized low band). 2) AST is able to serve MNOs with additional low band and mid band spectrum in spectrum starved areas such as major metros. They will be able to add to the spectrum available to MNOs today despite MNOs having reached the maximum amount of spectrum that MNOs are allowed to hold in most markets without introducing additional interference risks. This is clear, additional value to customers. a. This is raising the value of previously fallow, underutilized spectrum such as Grain and MSS spectrum (Ligado & S Band) and delivering for the highest and best use. AST SpaceMobile technology provides MNOs the ability to realize more profit on their spectrum through incremental Utility in Urban, Suburban, and Rural regions at no additional cost. I’m not going to talk about #2 above today, I think that’s fairly straightforward but may pick up again later.

On May 14, 2026, we announced that we have agreed in principle to form a new joint venture with AT&T Inc. and Verizon Communications Inc., or wholly owned subsidiaries thereof, which aims to end wireless dead zones in the U.S., including in rural areas, by pooling certain spectrum resources to increase capacity and help satellite providers reach more customers through a unified platform. The joint venture remains subject to negotiating definitive agreements between the parties and, if finalized, would be subject to certain customary closing conditions. At closing, in exchange for an equity interest in the joint venture, we expect to invest cash and license certain intellectual property to the joint venture, and will also commit to provide access to certain spectrum licenses to satellite service providers who contract with the joint venture.

Vast majority of usage is over wifi. We do get some indoor penetration but it depends on the indoor environment, i.e. windows, etc. Very good if in close proximity to window. Highlighting the wishful thinking of SPaceX buying spectrum and maintaining relationships with the MNO's. The MNO's know SpaceX is trying to steal their customers and are going to work with $ASTS instead.
Talks with Rogers communications included Ligado which has 40 MHz of spectrum that can be used to increase coverage and capacity. This would supplement the carrier’s existing low band and midband spectrum.
