Hey there, I am writing to you as the co-leaders of your party. I am increasingly worried about the erosion of protections for our rainbow community. The news about the "Legislation (Definitions of Woman and Man) Amendment Bill" got me thinking about when the late Georgina Beyer withdrew her bill which proposed to add gender to prohibited grounds for discrimination. Back then, she withdrew it because the attorney general wrote an opinion that it wasn't needed. So I looked into that opinion, and it left me very concerned. Basically it said that the specific mention of gender wasn’t needed because of international case law showing that gender discrimination was included within the definition in sex discrimination. Two of the countries mentioned in that opinion (the UK, and US) have radically shifted their approach to sex vs gender in the last few years (especially the recent UK supreme court decision), so I am not convinced that if the opinion was written today it would have the same conclusion. Some suggested actions: vote against the "Legislation (Definitions of Woman and Man) Amendment Bill" and anything like it if it comes up be vocal about protecting trans, intersex, and other minority peoples engage with the human rights commission on this topic push for a refresh of the attorney general's 2006 opinion to see if it still holds revive Georgina's bill to add gender to the prohibited grounds of discrimination
Hi there, I am writing to try and understand your reasons for introducing the Legislation (Definitions of Woman and Man) Amendment Bill. In particular I am interested in your thoughts on What if any impacts on trans, intersex, and non-binary communities you have considered, including what protections may be required to be added to properly protect those communities from harm What biological criteria would be used? and therefore how would your proposal classify intersex individuals Male? Female? or would they be neither under the law?
