It's still a pen, but his simulation makes it look like a dive from the ref's angle AND gives VAR justification to not overturn the ref's on-field call. A lot like Noni's pen in the CL final, just replace the slight arm pull with Kane's dive.

I also think there's a case to be made for the more theatrical the dive the less likelihood of the pen being given even if it was a foul
