• Equality and Human Rights Commission: Codes of Practice Clive Lewis: To ask the Minister for Women and Equalities, how she plans to support businesses groups who wish to remain trans inclusive in the context of the updated EHRC Code of Practice. Clive Lewis: To ask the Minister for Women and Equalities, what steps she is taking to include Trans safety in the implementation of the updated EHRC Code of Practice. Seema Malhotra: The Government received an updated draft Code of Practice from the EHRC on 13 April, and, whilst we cannot comment on the draft Code, we intend to lay it in Parliament in May. We have always been clear that duty bearers should set their policies in line with the law. If they are uncertain as to how to apply the Equality Act 2010, they should obtain specialist legal advice. We have also always been clear that the laws to protect trans people from discrimination and harassment remain in place.
We are writing to advise you that following a search of our paper and electronic records, we have established that the information you requested is held by the Cabinet Of ice. The information you have requested is exempt under section 35(1)(a) of the Freedom of Information Act, which protects the formulation of policy and communications between Ministers. Disclosure would weaken officials' and Ministers' ability to discuss controversial and sensitive topics free from premature public scrutiny. Section 35 is a qualified exemption, and we have considered whether the balance of the public interest favours our release of this material. There is a general public interest in disclosure of information, and we recognise that openness in government may increase public trust in and engagement with the Government. We recognise that government decisions may have a significant impact on the lives of citizens and there is a public interest in government deliberations being transparent. These public interests have to be weighed against a strong public interest that policy-making and its implementation are of the highest quality and informed by a full consideration of all the options. Of icials and Ministers must be able to discuss policy freely and frankly, exchange views on available options and understand their possible implications. The candour of all involved would be affected by their assessment of whether the content of the discussions wil be disclosed prematurely. If discussions were routinely made public there is a risk that officials and Ministers may feel inhibited from being frank and candid with one another. As a result the quality of debate underlying decision making would decline, leading to worse informed and poorer decision making. Taking into account all the circumstances of this case, we have concluded that the balance of the public interest favours withholding this information.

We want to reassure all of our customers that at Download, the majority of toilets will be gender neutral and available to all. There will also be single sex toilets provided. You acknowledge the requested information is held by the cabinet office but under section 35 of the freedom of information act you are choosing to withhold. The refusal issued constitutes a blanket non-disclosure, which I believe is contrary to the public interest. The use of exemptions without evidence of a public interest test being adequately applied or documented raises serious concerns. Grounds for Review: Public Interest Over Exemption Use. The decision to withhold all information under Section 35 does not appear to have balanced the legitimate and compelling public interest in transparency. Your response stated "There is a general public interest in disclosure of information, and we recognise that openness in government may increase public trust in and engagement with the Government. " You acknowledge release of information is beneficial in fostering trust in the government, something given the current highly charged debate around trans people lives and their very freedoms to live a full and free live within these shores A full refusal, without redactions or partial disclosures, suggests that the authority has not reasonably considered whether any portion of the information could be released and in so doing is increasing public mistrust in the government acting in a fair and equitable manor. I believe this alone is strong ground for release of this information. Transparency particularly where it concerns issues of human rights, equality, or institutional accountability is highly important when it comes to decision that may or may not curtail freedoms of citizens of the United Kingdom. A full refusal, without redactions or partial disclosures, suggests that the authority has not reasonably considered whether any portion of the information could be released and leads to the question why and what is being hidden?

Dear (— ENTER YOU MP'S NAME -), Request for Parliamentary Action on Legal Protections for Trans People and Clarification of the Equality Act Following Supreme Court Ruling Thave taken the liberty to include others in this email as relating to their individual areas of competence. I am writing as a constituent to express my deep concern about the recent Supreme Court ruling in *For Women Scotland Ltd v The Scottish Ministers* (2025), which held that the legal terms "man" and "woman" in the Equality Act 2010 refer strictly to biological sex, even in cases where an individual holds a Gender Recognition Certificate (GRC).' This decision stands in stark contradiction to the original intent behind the Gender Recognition Act 2004. When the legislation was introduced, the government was explicit in stating that a person with a GRC "will be regarded in UK law as being of the acquired gender for all purposes." This assurance was critical in establishing trust in the law and in the UK's commitment to upholding the rights and dignity of transgender people. By disregarding that principle, the ruling undermines established protections and opens the door to increased discrimination and exclusion, particularly in areas like healthcare, employment, and access to public and single-sex services.? It has caused considerable distress and uncertainty within the trans community, who already face disproportionately high levels of marginalisation and abuse." As your constituent, I urge you to:
