One of the most frequently misrepresented federal statutes—often falsely used to justify unconstitutional presidential war powers—is the War Powers Resolution (or Act) (50 U.S.C. §§ 1541-1550). If only more people would read it. Contrary to what you may have heard about the War Powers Resolution, it does not allow the president to take military action for any reason for 60-90 days without congressional approval so long as the president notifies Congress within 48 hours. Section 1541(c) of the War Powers Resolution states clearly: "The constitutional powers of the President as Commander-in-Chief to introduce United States Armed Forces into hostilities, or into situations where imminent involvement in hostilities is clearly indicated by the circumstances, are exercised only pursuant to (1) a declaration of war, (2) specific statutory authorization, or (3) a national emergency created by attack upon the United States, its territories or possessions, or its armed forces." Of the three cited authorities, not one indicates a presidential power to take unilateral (without Congress's approval) offensive military action. The first two authorities allow the president to take offensive military action but only with Congress's express approval (Article I of the Constitution grants Congress the exclusive power to declare war). The third authority allows the president to take defensive military action without Congress's approval in the event of a specific type of national emergency, a sudden unforeseen attack on the United States (happening too quickly for Congress to meet) necessitating immediate action to protect Americans. It's for this last situation (or for situations in which the president introduces forces into hostilities unlawfully) that the War Powers Resolution provides for the oft-mentioned 48-hour report to Congress (§ 1543) and 60-day (up to 90-day) timeline (§ 1544). Earlier this week, Josh got the bi-monthly memo that it’s time to attack the microblogging platform where tens of millions have flocked to avoid Elon Musk. He says it’s good for the Democratic Party that Democratic politicians are now spared the opinions of “most neurotic and censorious liberal influencers.” (It’s me. Hi!) And then he makes the classic error that indicates Elon has broken your brain: Josh forgets who won the 2020 election by seven million votes. He does this when he asks, “But was that actually ever good for liberal causes?”

Rogers gets crypto backing in Michigan Senate bid Scoop: Former Rep. Mike Rogers (R-Mich.) will have an ally in his second Senate run that he didn’t have in his first: crypto campaign cash. First Principles Digital, a new pro-crypto super PAC that supports Republicans, is endorsing Rogers’ 2026 bid and committing to a “multi-million-dollar” campaign spend in the primary and general election. Jason Thielman, the group’s executive director, called Rogers “the type of pro-crypto champion we need in Washington.” Here’s Thielman: “We are all-in on Mike. He’s the best choice and we want to see him in the U.S. Senate.” This endorsement is a shot across the bow to Rep. Bill Huizenga (R-Mich.), who has been staffing up ahead of a potential Senate run. The NRSC has urged Huizenga not to run — so far to no avail. Republicans would love to avoid a messy Senate primary in Michigan, which is one of their best pickup opportunities. Sen. Gary Peters (D-Mich.) is retiring and Democrats have a crowded field of candidates. Thielman was the executive director of the NRSC during the 2024 cycle when Republicans took back the majority. Under his tenure, the committee aggressively played in primaries to secure their preferred candidates. This spend is notable for two reasons: First, crypto forces were united against Rogers in 2024 — albeit different crypto forces. The Fairshake super PAC network backed Sen. Elissa Slotkin (D-Mich.) over Rogers, throwing more than $10 million behind her campaign. The only candidate who benefited more from crypto spending was Sen. Bernie Moreno (R-Ohio), who toppled former Sen. Sherrod Brown (D-Ohio) with more than $40 million in Fairshake support.

If there's one universally accepted truth in the modern age, it's that sequels suck. And Trump 2.0 will be no exception. Trump takes office with a plan to institute the worst parts of Project 2025. And he’s assembled a bloc of corporations and billionaires eager to do his bidding in exchange for tax cuts and corrupt favors. But he has no mandate for the staggeringly harmful agenda he’s about to unleash on the country. And together, we have the power to fight back — and win.
