Thank you for contacting the Prime Minister, the Rt Hon Sir Keir Starmer KCB KC MP, on 19 May about implications of the Supreme Court’s judgment in the For Women Scotland case. Your correspondence was passed to the Office for Equality and Opportunity, who have provided me with information to respond. On 16 April 2025, the Supreme Court ruled that the terms ‘man’, ‘woman’, and ‘sex’ in the Equality Act 2010 refer to biological sex. It stated that a Gender Recognition Certificate does not change a person’s legal sex for the purposes of the Equality Act 2010 (the 2010 Act) alone. This Government is committed to protecting single-sex spaces based on biological sex. It is also clear that trans people are protected by the 2010 Act. Following two periods of consultation, the EHRC’s updated Code of Practice for services, public functions and associations (the ‘Code’) reflects clarifications in the law including the For Women Scotland Supreme Court ruling. This Government’s priorities have always been ensuring that those providing services, exercise public functions, or run associations have practical guidance on how to implement the 2010 Act, while upholding dignity and respect across all nine protected characteristics. The Code is important in instructing duty bearers how to achieve that balance. The Secretary of State, the Rt Hon Bridget Phillipson MP, has approved the draft Code, and laid it in Parliament on 21 May 2026. As specified in the Equality Act 2006, Parliament now has a 40 day period to scrutinise the draft. During this time, duty bearers should follow the law as clarified by the For Women Scotland Supreme Court ruling and seek specialist legal advice if needed.

Thank you for contacting the Cabinet Office on 8 April about trans people’s ability to live safe and positive lives. The recent Supreme Court ruling clarified the application of the Gender Recognition Act 2004 (GRA) in relation to the protected characteristic of ‘sex’ in the Equality Act. Following that ruling, trans people are still protected from discrimination and harassment in the Equality Act. Those with a Gender Recognition Certificate (GRC) are still recognised in their acquired sex and gender in other circumstances unless specific exceptions apply, with the Equality Act now recognised as being one such exception. A GRC still allows them to legally change their sex for the purposes of a number of important life events, including – birth, death, marriage and civil partnership certificates, for example. Please be assured that the Government is also committed to tackling all forms of hate crime. There remain strong protections in place for LGBT+ communities to live free from discrimination. There will be zero tolerance for hate crimes of any kind, and the Government will always support the police in taking the strongest possible action against the perpetrators of these abhorrent offences. Working in partnership with the Home Office, the Government is delivering its manifesto commitment to equalise all existing strands of hate crime to make them aggravated offences, ensuring parity of protection for LGBT+ and disabled people. This Government believes all people should be able to access the healthcare they need. NHS England has increased the number of adult Gender Dysphoria Clinics in England from 7 to 12, with the rollout of 5 new adult gender pilot clinics since July 2020. In addition to this, NHS England is carrying out a review of adult gender services, with the aim of producing an updated service specification.
