User specifies what should be made and distributes results. Same if I ask it to generate some harmful story about you and spread it, right? Does anything change if I ask it to be generate it about a fictive person and change your name in the results before publishing it?

Generating content makes xAI a publisher, not a platform, so Elon will learn a hard lesson on that one
Off the cuff I'd say it's both. The user should bear more of the responsibility; but the company should take reasonable steps to prevent abuse of its services. There are a lot of problems though, and hard cases make bad law.

This is 100% the user’s fault & AI should not be guard-railed & hobbled to prevent misuse. The AI is not liable for misuse. The user is. If I use a Mac to commit a crime online is Apple to blame? Should MacOS be hobbled & guard-railed to thwart people from committing crimes with Apple computers?
Musk is looking for SCOTUS to grant him the same immunity gun manufacturers have.
