Abstract of Perspectives on Politics article "The Countermajoritarian Difficulty Revisited: Theorizing Court-Party Relations in the United States". The article argues that increases in interparty competition and intraparty cohesion has made the Supreme Court increasingly prone to counter-majoritarian decisionmaking.
An article abstract arguing that the emergence of the major questions doctrine will exacerbate the problem of policy drift -- the phenomena where policies change over time as they fail to adapt to changing socioeconomic conditions.
