Plaintiffs are not asking for damages or compensation for Defendants’ prior conduct; they want the Court to impose forward-looking, declaratory and injunctive relief against Defendants. This means that past exposure to illegal conduct, no matter how egregious, is not enough to carry the day. Plaintiffs must demonstrate that their harm is ongoing or will almost certainly and imminently befall them again. Because they have not met their burden to make this showing, the Court finds that they lack standing to obtain the relief they seek.
Upon a fulsome review of the record in this case, it is clear that Defendants have, in some instances, unlawfully arrested and detained non-citizens in Ohio without a warrant and without a probable cause determination of their likelihood of escape. Some of the accounts offered by Plaintiffs and those they wish to represent about how individual agents effectuated arrests deeply trouble the Court. But

At 8:58 a.m. on September 26, 2025, without warning, an agent directly aimed at and shot Geary in the face with pepper bullets from across a parking lot while Geary sheltered behind a vehicle with other photographers. In June 2019, a Blue Ribbon Commission met to produce a policy document they called The Migrant Justice Platform.1 Created by representatives of Latinx, Asian, Middle Eastern, and migrant labor organizations, like the National Day Laborer Organizing Network (NDLON), this “unity blueprint” set out to establish a “new conversation about migration” tied to shared social and economic concerns of “impacted communities” comprised of citizens and noncitizens across the US. The document went further in considering the “the whole of the global crisis” than the elected leaders charged with managing public health, security, and welfare. Their proposal, to “build bridges, not walls,” met the ravages of this era with principles for decriminalizing mobility and constructing a solidarity economy across borders. These principles guided the most effective resistance to authoritarianism in 2025. And they did so by providing language that resists the separation of citizen and noncitizen concerns, and by confronting openly the complexity of their relations.
The current ICE-OUT campaign has not been driven by the principles and values of the historic immigrant rights framework. Past tenets—that the US is a nation of immigrants, and that the unauthorized migrant presence is a problem to be solved by bargaining for a limited legalization of the deserving—lost traction and coherence over decades of stalled immigration reform. Mass opposition to ICE owes its energies to decades of painstaking organizing, especially by migrant-led organizations like the National Day Laborer Organizing Network, Alianza Americas, the Black Alliance for Just Immigration, and other more grassroots collectives. These groups emerged in the early 2000s to challenge the illegalization of diasporic populations, and to expand protections for undocumented workers and students under assault.

Ochoa Ochoa v. Noem: Due Process Having concluded that Ochoa Ochoa's detention is discretionary and not mandatory, the court turns to whether it violates due process. Thuraissigiam, where the Supreme Court held that a petitioner who was still "at the threshold of initial entry," though technically in the country, could still be treated as "an alien seeking initial entry." 591 U.S. 103, 114 2020) holding that a noncitizen detained "within 25 yards of the border" is treated as if stopped at the border and had not acquired due process protections). Contrary to Respondents' position, Thuraissigiam held only that noncitizens detained close to the border "shortly after unlawful entry" have not yet "effected an entry." Id. at 140; see also Shaughnessy v. United States, 345 U.S. 206, 212 (1953) (explaining that noncitizens "on the threshold of initial entry stand[] on a different footing" than those who have "passed through our gates").

Among the public, policy makers, and many academics, a common expectation is that the concentration of immigrants and the influx of foreigners drive up disorder and crime because of the assumed propensities of these groups to commit crimes and settle in poor, presumably disorganized communities. This belief is so pervasive that, as shown in chapter 6, the neighborhood concentration of Latinos strongly predicts perceptions of disorder no matter what the actual amount of disorder or the rate of reported crimes. Yet increases in immigration are correlated with less crime, and immigrants appear to be less violent than those born in America, particularly when they live in neighborhoods with high numbers of other immigrants.
