On this basis, Kavanaugh concludes that preventing trans girls from playing women’s sports is a reasonable policy choice, and that lawmakers may make it without running afoul of federal law or the Constitution. But he also tries to downplay the impact of B.P.J. by emphasizing the ostensibly unique nature of sports. For example, he distinguishes between discrimination against trans women athletes—in his view, fine—and discrimination against trans women in settings like classrooms or workplaces, where sex-based differences in, say, “jumping ability” are not relevant. The “factual contexts,” Kavanaugh explains, are “vastly different.” For anti-trans crusaders within the conservative legal movement, this is a distinction without a difference. Activists pushing sports bans are not motivated by some earnest desire to protect girls’ lacrosse players from concussions. They are using sports as a transphobia gateway drug—a tool for persuading people who are not steeped in right-wing culture wars to see at least one form of discrimination against trans people as a matter of common sense. As the journalist Sydney Bauer wrote in Balls & Strikes last summer, cases like B.P.J. “are about more than just sports—they are about the ability of anti-trans lawmakers to freely discriminate against their constituents without fear of legal repercussions.”
In the paragraph that follows, I am going to briefly subject you to something that, if I were not writing a newsletter, I would not ask my worst enemy to read: insights from the mind of Riley Gaines, whose ability to parlay a fifth-place finish at a college swim meet into a career as an anti-trans podcaster is a tribute to what late-stage capitalism can accomplish. “I think we’re going to continue to see movement and allow the people’s voice to be heard, especially in some of those purple states,” Gaines told Politico last month, after the Supreme Court in West Virginia v. B.P.J. upheld state lawmakers’ power to bar trans girls from playing women’s sports. “Each major decision gives your ordinary person more cover to say something that…was the standard, like the default position to take, really not that long ago.” In other words, B.P.J. is not (only) about keeping girls like 16-year-old Becky Pepper-Jackson from playing on the same team as her friends. It is about empowering people to feel more comfortable expressing rank bigotry in public.

Set aside, for today, the question of whether it is “appropriate” for an ostensibly independent federal judge to feel so passionately about the president who appointed him that he plasters the president’s grim visage across a little screen he carries with him everywhere he goes. Doe, a case about Trump’s efforts to cancel temporary protected status for some 350,000 Haitian people and 6,000 Syrian people living in the United States. In (another) majority opinion from Alito, the Court said that doing so was fine, and rejected the notion that the president’s history of describing Haitian people as “filthy,” “disgusting,” and “poisoning the blood” of America might be at all legally relevant. Alito instead described Trump’s comments as “heated language” and not “overtly racial,” which is roughly analogous to describing Petey Pablo’s 2003 hit single “Freek-a-Leek” as not “especially sexual” and “mostly just a list of women’s names, if you think about it.”

The portion of the opinion that consists of legal analysis is just 21 pages long, and treats all the underlying questions as if they all have easy, obvious answers. It is the work product of a six-justice conservative supermajority whose members are fluent in anti-trans rhetoric, and comfortable converting its tenets into anodyne-sounding legalese: There are solemn discussions of the “inherent physical differences between the sexes,” for example, and the “zero sum” nature of roster spots and playing time, and the injustice of “forcing” cisgender girls to “play against biological males” in “what they view as an unfair competition,” and so on. If Kavanaugh had invited Riley Gaines to ghostwrite his opinion in B.P.J., I am not sure anything about it would have turned out differently. The respondent in this case is Becky Pepper-Jackson, a trans girl challenging a ban on trans girls playing women’s sports that the West Virginia legislature passed in 2021. (Because she is a minor, the Court refers to her by her initials.) Pepper-Jackson, who began receiving gender-affirming medical care in elementary school, argued that the ban violates Title IX, a federal law that prohibits sex discrimination in schools. She also raised a constitutional claim, arguing that by restricting participation in women’s and girls’ sports to athletes who were assigned female at birth, West Virginia’s ban discriminates on the basis of sex in violation of the Equal Protection Clause of the Fourteenth Amendment.

Instead, gender dysphoria re- sembles other characteristics on the basis of which legisla- tures may classify with a merely rational basis. See, e.g., Heller v. Doe, 509 U. Legislatures have many obvious rational bases to keep men who believe that they are women out of teams and private spaces reserved for women. Second, as the Court recognizes, this case concerns “bio- logical men” and “boys who identify as girls.” Ante, at 10, 27. Men and boys with gender dysphoria are not women or girls, even if they believe that they are. Sex is an immuta- ble “biological” characteristic, see ante, at 10; it is binary; and “man” and “woman,” “boy” and “girl,” are the terms that correspond to adults and children of each sex. See A. Byrne, Are Women Adult Human Females? 177 Philosophical Studies 3783, 3786–3787 (2020). To use language to ob- scure reality—to show “indifference regarding the truth”— is to lie to the public and cease to treat our fellow citizens “as equal[s].” J. From there, Alito transitioned to the subject on which he and Justice Brett Kavanaugh fixated at oral argument: that grace periods create “opportunities for voter fraud” that the Court has a solemn duty to extinguish. To support his case, Alito offered an elaborate hypothetical about a tight race in which “bad actors seeking to stuff ballot boxes” manage to “flip” the apparent result. Counting ballots that “pour in” after Election Day, he said, creates a “serious risk” of undermining public confidence in “our system of self-government.” Set aside, for today, Alito’s characterization of the administrative vote-counting process as “flipping” an election, as if winners were determined not by which candidate receives the most votes, but the order in which votes are tabulated. As is always the case when Republicans frame their antipathy for mail-in voting as motivated by a noble, good-faith concern about the perception of voter fraud, Alito omits the simple fact that his party and his president are fueling it. His rhetoric in Watson is indistinguishable from Trump’s social media rants, except that Alito’s opinion has fewer typos and does not abuse the CAPS LOCK key as much.

For instance, do the federal election-day statutes impose any ballot-receipt deadlines? Mississippi counts absentee ballots that arrive up to five days after the federal election day, but nothing in the majority opinion turns on that 5-day duration. Indeed, some States will count mail-in ballots that arrive as late as 21 days after election day. See Wash. Rev. Code §29A.60.190 (2025). If the “election” is complete when voters fill out their ballots and send them on their way, may States eliminate ballot-receipt deadlines en- tirely? It appears that the only federal backstops for ballot receipt are the date when newly elected Representatives and Senators must report for their swearing in and the date when Presidential electors must cast their votes. Next, would it suffice under federal law if a State author- ized voters to tender their ballots to any third party by elec- tion day? Mississippi counts late-arriving absentee ballots only if they are sent using the Postal Service or a common carrier. Miss. Code Ann. §23–15–637(1)(a). But nothing in the election-day statutes gives those entities special treat- ment. Could a State therefore count late-arriving ballots if they are delivered by some other intermediary? How about a relative of the voter? A helpful neighbor? An Uber driver who agrees to serve as a courier?10 A “ballot harvester” af- filiated with a political party or interest group? See ante, at 20 (not disputing that the election-day statutes would al- low a regime where voters could give their ballots to these intermediaries on election day for later delivery). May States use something other than a ballot’s postmark to determine when someone voted? Mississippi requires that an absentee ballot be postmarked on or before election day, but other States do not. See, e.g., Cal. Elec. Code Ann. §3020(b)(2) (West Supp. 2026) (relying on the date that a

But if it is going to be our precedent, the majority should at least endeavor to apply it faithfully. I respectfully dissent because the majority has failed to do so here, and its analysis and conclusion only further bind the hands of mod- ern legislatures attempting to balance and protect their res- idents’ interests. With this decision, the Court has now ma- nipulated Bruen into a free-for-all that lets the Judiciary thwart the will of legislatures by privileging access to fire- arms above all else. Today’s decision makes one thing clear: The Court’s objective is protecting guns, not consistently preserving any principle of law.

We can put aside the question whether they are legitimate evidence of the Second Amendment’s scope, post, at 30–32 (opinion of JACKSON, J.), because regardless, they do not help Hawaii. The State seems to think Bruen is a matching game: South- ern States enacted broad default rules, Hawaii reasons, so it can do the same today. But even if Hawaii is right that the how is analogous, it also must identify an analogous why. The Black Codes were enacted to subordinate newly freed slaves.10 Hawaii obviously does not contend that its law promotes an analogous interest. So its law and the de- fault rules in the Black Codes are not “‘relevantly similar.’” Bruen, 597 U. S., at 29. Most would take that as a compli- ment.

And this was well-understood by the Republicans in Congress who were responsible for drafting, approving, and securing the ratification of the Fourteenth Amendment. The Republican Party Platforms of 1856 and 1860 called for protection of the right to keep and bear arms for self-defense. Unless we put history en- tirely out of our minds, Hawaii’s claim that this tainted ar- tifact illuminates the original understanding of the right to keep and bear arms cannot be taken seriously. * * * The Hawaii law at issue here violates the constitutional right to keep and bear arms. Therefore, the judgment of the Court of Appeals for the Ninth Circuit is reversed, and the case is remanded for further proceedings consistent with this opinion.
